Residential Landlord - In brief

Landlords in Scotland need to prepare
for proposed changes to rental sector

Scottish landlords must act quickly if they want to attend the last NLA Landlord Expos being held at the Inchgarth Community Centre, Aboyne Place, Aberdeen, on 4 June, from 12-7pm.

Similar events have already been held in Glasgow and Edinburgh when landlords had the opportunity to meet property experts covering all aspects of renting in Scotland from finance and purchasing to tax, HMO licensing, and all matters relating to tenancies.

With the Scottish Government intending to bring forward yet more changes for the sector, the expos enable landlords to discuss what the future of renting will be like for Scottish landlords and their tenancies in the coming months.

David Kendall, NLA Scotland, said: “Scotland has a healthy private-rented sector but landlords need to be prepared for every eventuality given the Scottish Government’s stated intentions.

“These NLA Scotland events are a fantastic opportunity for landlords of whatever portfolio size to get together and hear about changes which could affect their lettings business as well as get advice from some of Scotland’s top property experts.”

Entry to the events is free.

Holiday home landlords offered
help when dealing with squatters

The risk of squatters occupying well managed holiday cottages marketed at a fair rate to ensure high occupancy throughout the year is fairly slim, but the problems surrounding the supply of affordable housing in rural and coastal areas means the threat is ever present.

When a holiday home is taken over by squatters, the legal position is usually simple - the owner can obtain an eviction order. However, the process can be dragged out by technicalities and end up taking time to sort out.

To help buy to let holiday home owners deal with such a situation, Boshers holiday home insurance policy has a bespoke Legal Expenses section arranged by Ecclesiastical with DAS Legal Expenses Insurance Company Limited. The policyholder benefits from a bespoke holiday let section.

DAS will negotiate for policyholders legal rights to evict anyone in their property who does not have their permission to be there but not including claims arising from or relating to a lease of land or buildings of more than 56 days.

Under section 6 of the Criminal Law Act 1977 it is a criminal offence to use violence or a threat of violence to gain entry to a holiday home if someone, such as a squatter, is present. But it is not a criminal offence to go in yourself, if you do it peacefully, or to break back in and change the locks if no one is there. That is why squatters lock doors and keep one person in at all times.

Different rules apply if squatters move into a holiday home that is occupied. In that case, the holiday home owner can force a way in.
